End User License Agreement (EULA)
This End User License Agreement (“EULA”, “Agreement”) is a legal contract between you (“User” or “you”) and Tehsil Mobile / Cloudway Solutions (“we”, “us”, or “our”). By installing, accessing, or using the Tehsil Mobile application or website (the “App” or “Service”), you agree to be bound by this EULA. If you do not agree, do not install or use the App or Service.
1. License Grant
Subject to your compliance with this EULA, we grant you a limited, revocable, non-exclusive, non-transferable license to use the App for your personal or internal business purposes, solely as permitted by the features of the App and documentation. No rights to resale, distribution, sublicensing, or commercial exploitation are granted.
2. Restrictions
Unless expressly authorized in writing, you must not:
- Reverse engineer, decompile, disassemble, or attempt to derive source code from the App;
- Modify, adapt, translate, create derivative works from, or otherwise tamper with the App;
- Distribute, transfer, rent, lease, sublicense or sell the App or any portion thereof;
- Remove or alter any proprietary notices or labels on the App;
- Use the App to store or transmit illegal content or to commit unlawful activities.
3. Intellectual Property
All rights, title and interest in and to the App, related content, trademarks, logos, text, images and software are owned by Tehsil Mobile or our licensors. This EULA does not grant you ownership of any intellectual property rights.
4. Updates and Upgrades
We may provide updates, upgrades, bug fixes, or new versions. You consent to automatic updates that may be required to use the App. Continued use after an update indicates acceptance of the updated terms.
5. Third-Party Services, Ads & Analytics (AdSense / AdMob)
The App or website may use third-party services such as Google AdSense / AdMob, analytics providers (e.g., Google Analytics or Firebase), mapping providers, and other APIs. These third parties may collect or process data (including identifiers and cookies) under their own policies. We do not control those third parties’ practices. Ads & Monetization: the App may show personalized or non-personalized ads. If you are in the EU/EEA, we rely on consent or legitimate interest as described in our Privacy Policy. You may opt out of ad personalization via your device settings or Google Ad Settings.
6. Privacy & Data
Use of the App may involve collection and processing of personal data. Our Privacy Policy explains what data we collect, how we use it, retention periods, and how to exercise your rights (access, correction, deletion, portability, objection). We aim to comply with GDPR, CCPA and other applicable laws where applicable.
7. Warranty Disclaimer
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE APP AND SERVICE ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT.
8. Limitation of Liability
IN NO EVENT WILL TEHSIL MOBILE, CLOUDWAY SOLUTIONS, ITS AFFILIATES OR SUPPLIERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF YOUR USE OF OR INABILITY TO USE THE APP, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR AGGREGATE LIABILITY ARISING FROM OR RELATED TO THIS EULA SHALL NOT EXCEED THE GREATER OF (A) INR 1,000 (ONE THOUSAND RUPEES) OR (B) THE AMOUNT YOU PAID FOR THE APP IN THE PRIOR 12 MONTHS, IF ANY.
9. Indemnification
You agree to indemnify, defend, and hold harmless Tehsil Mobile, its affiliates, officers, directors and employees from and against any and all claims, liabilities, damages, losses and expenses (including reasonable legal fees) arising out of or in connection with your violation of this EULA or your use of the App.
10. Termination
This EULA is effective until terminated. We may terminate or suspend your license immediately if you breach any term of this EULA. Upon termination you must cease all use of the App and delete all copies in your possession.
11. Governing Law & Dispute Resolution
This EULA is governed by the laws of India. Any disputes will be subject to the exclusive jurisdiction of the courts in Punjab, India, unless otherwise required by mandatory law.
12. Export Controls
You agree to comply with all applicable export and re-export laws and regulations that apply to the App and to not export or re-export the App in violation of such laws.
13. Changes to this EULA
We may modify this EULA from time to time. We will post the updated EULA on this page with the revised “Last Updated” date. Continued use after changes constitutes acceptance of the modified EULA.
14. Severability & Waiver
If any provision is held invalid or unenforceable, the remainder of the EULA will remain in full force. Failure to enforce a right does not constitute a waiver of that right.
